In this policy, "Modscale", "we", "us" and "our" refer to the above. "You" refers to any person whose personal data we handle.

Under the Digital Personal Data Protection Act, 2023 ("DPDP Act"), Modscale is the Data Fiduciary in respect of the personal data described below.

2. Information We Collect

2.1 Information you give us through enquiry forms

When you submit an enquiry through our website, or through a lead form on Facebook or Instagram, we collect:

• Full name
• Email address
• WhatsApp / mobile number
• Property type (2 BHK, 3 BHK, 4 BHK, villa, duplex or independent house)
• Indicative budget range for your project
• Expected handover date of your home
• Scope of work you are considering
• Name of your project, apartment or locality
• Your preferred time for a call

Where you submit an enquiry through a Meta (Facebook or Instagram) lead form, your name and email address may be pre-filled by Meta from your Meta account profile. You may edit these before submitting.

2.2 Information collected automatically when you visit our website

• IP address
• Browser type and version, device type and operating system
• Pages viewed, time spent and referring website
• Cookie and similar identifiers

2.3 Information collected during a project

If you engage us, we additionally collect:

• Site address and access details
• Floor plans, layouts and site measurements
• Photographs of your site and completed work
• Design preferences and material selections
• Billing details, payment records and GST details where applicable

We do not intentionally collect any special category or sensitive personal data. Please do not send us such information.

3. How We Collect It

• Lead forms on Facebook and Instagram, operated through Meta Platforms
• Enquiry and contact forms on modscale.in
• WhatsApp messages to our business number
• Telephone calls and emails
• Walk-in visits to our HSR Layout experience centre
• Referrals, where a person has shared your contact details with your knowledge

4. Why We Process Your Data

Our lawful basis is your consent, given when you submit an enquiry or engage us, and for certain purposes the legitimate uses permitted under the DPDP Act. You may withdraw consent at any time — see Section 8.

5. Who We Share Your Data With

We do not sell your personal data.

We share it only as far as necessary, with:

• Meta Platforms Ireland Ltd / Meta Platforms Inc. — where you submit a lead form on Facebook or Instagram, message us on WhatsApp, or where our advertising measurement tools operate
• Google LLC — Google Workspace, Sheets and Drive, which we use to store and manage enquiry records
• Design and execution partners — carpenters, contractors, fabricators and installers engaged on your project
• Material vendors and suppliers — where an order must be placed against your specifications
• Payment processors, accountants and legal advisers
• Government authorities, where disclosure is required by law

Some of these providers process data on servers outside India. Where that happens, transfers are made in accordance with the DPDP Act and applicable Government of India restrictions.

6. Cookies and Tracking

Our website uses cookies and similar technologies to keep the site working, remember preferences and understand how visitors use it.

You can block or delete cookies through your browser settings. You can control the ads you see from Meta in your Meta account's Ad Preferences.

7. How Long We Keep Your Data

We delete or anonymise personal data once these periods expire, unless we are legally required to retain it.

8. Your Rights

Under the DPDP Act, you have the right to:

• Access — obtain a summary of the personal data we hold about you and how it is processed
• Correction — have inaccurate or incomplete data corrected, completed or updated
• Erasure — have your personal data deleted, where we are not legally required to retain it
• Withdraw consent — at any time, without affecting processing already carried out
• Grievance redressal — raise a complaint with us, as set out in Section 9
• Nominate — nominate another individual to exercise these rights on your behalf in the event of your death or incapacity

To exercise any of these, write to info@modscale.in. We will respond within 30 days.

If you are not satisfied with our response, you may escalate to the Data Protection Board of India.

9. Grievance Officer

In accordance with the DPDP Act, 2023 and the Information Technology Act, 2000:

Complaints are acknowledged within 24 hours and resolved within 30 days of receipt.

10. How We Protect Your Data

We apply reasonable security safeguards, including:

• Access controls restricting enquiry records to authorised team members
• Password protection and access management on the accounts holding client data
• Sharing your details with vendors and partners only to the extent needed for your project
• Periodic review of who has access to client records

No method of transmission or storage is completely secure. We cannot guarantee absolute security, but we will notify you and the Data Protection Board of India of any personal data breach as required by law.

11. Children

Our services are directed at adults. We do not knowingly collect personal data of anyone under 18. If you believe a child has provided us their data, write to us and we will delete it.

12. Changes to This Policy

We may update this policy from time to time. The revised version takes effect when published on this page, and the "Last updated" date above will change. Where changes are significant, we will take reasonable steps to notify you.
